I didn't know that somebody could effect the Shiavo case with a lawsuit in another Federal Court. If this is the case, then maybe conservative activist could win this by filing similar disability lawsuits in more favorable Federal Courts.

If the Fed Courts can't effect each other with lawsuits, Congress can write laws about the enforcement of disabilities. Or they can write a federal version of the law that the Florida Legistlator tried to push through a few days ago.

Did the CNN reporter just say that the Schindler's lawyers couldn't get this petition filed by a Saturday deadline because of the flurry of activity? This is so frustrating.

I just heard the same thing. Apparently, the Schindlers now have to find a judge to hear the case. This is just so confusing. I'm off to bed, I have a very early meeting tomorrow morning.

It would seem that by directing a DE NOVO hearing, the reinsertion of the feeding tube is implied.

That's what part of Congress was hoping. Unfortunately, in a circumstance where there's a dispute on an issue, and issuing an injunction would, in effect, decide the case for the petitioner (at least for the time being) the court has to be convinced the petitioner has a chance of winning at trial.

There's another option, under the "all writs act", and you can read the discussion of that in the dissent to the prior appeal to the 11th. The majority did not find that argument convincing.

The specific question of whether Congress was ordering the judge to issue a reinsertion order was raised during the debate in the Senate, and both sides agreed that it was not, in fact, doing so. I think the Republicans believed they were creating a box, and the Democrats correctly perceived that the box only had three sides. Whittemore found the fourth side.

The man belongs in a Federal Prison and I for one don't want to rest until that day comes.

The list of this man's crimes is neverending and he will not get off the hook. He needs to be made an example of to every other egomaniac judge who wants to play God in our nation's courtrooms.

What happened to our soldiers in Iraq who put women's panties on a prisoner's head? Where are they now?

I got it the second time he went over it, I think..

He meant to say that it was part of the appeal that if the court chooses to hear the case that the tube is inserted in the meantime...

Well, if it is to matter they better act fast.
