Governor Bush is Just Following Orders

I think that one of the greatest legacies that the founding fathers left for us was the rule of law, codifed in the form of our small R republican constitution, federalist principle and separation of powers. But in this Schiavo case, we are being constantly told that adherence to that rule of law demands that we countenance an innocent woman starving to death by judicial fiat. If that is so then I say the noble legal edifice of federalism has failed and it is time to implement the higher natural law that all this legal authority originates from. Those laws are best summarized in the second paragraph of the Declaration of Independence, and by the natural law theory propounded by St. Thomas Aquinas. With the Schiavo case, many in this country have internalized the positivist legal ethics of Nazi euthanasia law.

I am not saying that a mob should go to Terry's hospice and seize her. I do believe that Jeb Bush, under color of his authority as the Chief Executive Officer of Florida should take Terry Schiavo into custody. In his executive embodiement as a co-equal branch of government he cannot be held in contempt for such action by any Florida court. No state court can order him to do or not do anything. This is not to say that political risks would not entail. He would be subject to impeachment for such an action by the Florida Legislature, and or removal from office by the electorate if they think his actions are wrong. Jeb Bush has to ask himself is it worth risking his political future to save the life of a brain damaged woman? I don't know if I myself would have the political courage to do it, but if Jeb Bush can’t, he should .

Reasonable people and unreasonable people, sometimes known as lawyers, disagree on Gov. Bush using his executive power. They fear a Constitutional crisis. Too late. Judge Greer started the crisis, this Dred Scot, with his judicial tyranny. The judge would hold the Governor in contempt. It would take an Andrew Jackson or Abraham Lincoln to be so bold. But, Jeb Bush, nice guy that he is, well-meaning man, and good Catholic, is no 'Old Hickory' and no "Honest Abe'. Jeb, like every defendant at Nuremburg save one, pleads 'not guilty' because he is just following orders.

Bingo. We shouldn't expect more from the party of death. But I expected more from Jeb.

My votes will go to the most conservative on the ballot....

I sure as hell hope so, unless ya wanna see Hillary in office, as well as many of her cohorts. Don't make the mistake of Dems in 2000, when they split their ticket....
