Follow the Constitution Gov. Bush: Grant Clemency to Terri Schiavo
Empire Journal | March 28, 2005 | Anon

Since I'm only allowed to post a link, here it is.

http://www.theempirejournal.com/0328051_follow_the_constitution.htm

This is a really good article on one of Jeb's reamining options to help Terri, which he refuses to take.

The article urges him to launch an immedite criminal investigation into the whole case, then take her into custody as part of the investigation, then grant her clemency, thus putting her out of reach.

President Bush would never have to intervene if Jeb would do his damn job and get some balls.

How do you know that Greer isn't adhering to the laws of the state of Florida? I do realize that judges are activist when they want to be and strict constructionists when it suits them - but resparators and feeding tubes are pulled all the time by court order. Is Judge Greer really that far off-base from the actual laws of Florida?

I don't know the laws myself - however, it wouldn't surprise me if the laws were this screwy. If they are, executive action might save Terri - but someone else will face the same plight sooner or later. If there are problems with the Florida laws, they need to be changed. If Greer was that far out of line, he needs to be impeached. Both are functions of the legislature.

Don't worry,he wouldn't ask for your vote.
Jeb & Co.were the one's who got the Fla.Legislature to try to replce the tube, but it was defeated.
Why do we need to find blame for everything.Hope no one finds out the name of the R.N. who pulled the tube out.

He also had suspended haebas corpus and did a lot of other extra-constitutional stuff.

Yes, and the nation survived and he became one of the most popular presidents in history.

Are you trying to argue that the Federal government (i.e., the Rights of the People as enumerated in the Constitution) does not overrule the States when those states infringe upon enumerated rights?

come on this site and pose these fallacious, intellectually vacant arguments about the sanctity of our precious judicial system, in a matter like this is sickening, to say the least.

Who says this is just a problem with our judicial system? I would venture that the problem lies with the laws of the state of Florida.

A lot of liberal cheered when Slick seized Elian, without legal justification and in defiance of court orders. Most conservatives saw a problem with that action. Do we now cheer on executive action when it suits us this time?

Prove it!

She is legally married. She has a husband who is making the decisions. He has a court which agrees with him.

Please tell me what that crime was again ..??

You are unhappy with what's going on .. so am I .. but just because we believe there is a crime doesn't mean there is sufficient evidence to support our beliefs.

People want the Bush brothers to OPERATE OUTSIDE THE LAW - they are not going to do it. They just placed their hand on a Bible and SWORE to uphold the law. Your requirements are invalid.

Please show me where state court decisions regarding who is taken off life support or a feeding tube are the proper realm of federal action under the Constitution - except where previous liberal activist actions have made it such.

I'm as sick as anyone at what happened here. But the only real remedy is to address the state laws and state courts that allowed this to happen. Federal action is a temptation, to paraphrase Judge Bork - and we're all getting tempted to unleash the federal genie becaus it suits us now. But the genie never goes back into bottle afterwards.

Yes, and the nation survived and he became one of the most popular presidents in history.

Bill Clinton was popular as well. Popular does not always equate to being righteous. And Clinton was one of the worst abusers ever of federal power in pursuit of political agendas that were outside the realm of the written Constitution.

And in the meantime, DCF doesn't have to obey rogue court orders regarding laws ALREADY ON THE BOOKS. They were on the way to save her but got turned back. That's all I need to know.

I don't agree. Because even if it was his family member - how could he subvert the law - you're making illogical reasons to try to foster your theory that Jeb should break the law just because .. just because. That's just not a good enough reason.

Why not, W has already shown complete disdain in following the law when it relates to the Clinton crimes.

Bill Clinton was pursued up one wall and down the other during his tenure, and used the power of his office to cover up. The Constitution calls on Congress, not presidential successors, to police presidents, and Congress failed in that regard.

Berger is still being investigated, and, last I checked, it was not an abuse of federal power to make a dumbass comment about the Minuteman Project - Bush has the same right to be stupid as anyone else, and we have the right to chew on him for it. But none of those represent federal abuses of power, where Bush does something that is denied him by the Constitution.

Yep. I'm in favor of limited government unless it limits what I want government to do.

The motto of many Freepers these days, and my new tagline.

Then the balance of power between judges, the executive and local police forces needs to be addressed in the state of Florida.

Thanks for a fact, I haven't seen one of those in a while.... :^)

I just get upset with Congress, if they bother to issue an order or sopeaena (no clue how to spell it) for her to come to the hill, they're showing me nothing by not enforcing it...

And it would have been addressed if Jeb had the balls to ignore the court order that contradicted a codified law. He ran to the finish line to protect Terri then he quit.

I believe God has answered the prayers but no one is listening. This was a wakeup call for us to focus our efforts on electing and appointing moral judges.

Instead, I see vitriol. I see "groups" who are ready to pounce on any sign of disagreement with them. I see hate-filled, angry posts. Yes, Satan is smiling about that.

I know it's an old-fashioned, quaint notion, but I'm crusty that way.
