The Judge dis-regarded any and all evidence of abuse my Michael Schiavo. In order to get up to speed, here is a starting point -

He didn't even call 911 nor did he do CPR on Terri. He called her dad first, then the dad called the brother. The dad told the husband to call 911. When brother arrived, Terri was still lying face down, while Michael Schiavo sat on the couch crying and acting like a lunatic.
My guess, is the HINO Schiavo, thought Terri was already dead and he didn't need to worry about her anymore. Imagine his surprise, when the paramedics revived her.
