She passed the point of no return, for practical purposes, when the Shindler attorneys dropped the ball in their first trip to Federal Court.

It looked like that then, but we have more decisions and opinions since then. Do you think this case stands as a success story for the judicial system? What about the dissent at the 11th Circuit, is he wrong?

The case is not a success story for the judicial system. For the judicial system to work, however, the lawyers need to do their part, too.

Best as I am aware, the Schindler lawyers are pretty notable screwups. Their big chance was to get a genuine full de novo review, with new discovery and new evidence, once they got to Federal Court. They didn't. If they took that posture the court would have had to reconnect her feeding tube pending the final decision, as a practical matter.

The lawyers treated their trip to Federal Court as if it were an appeal of the State Court. Bad lawyering. In fact, it's just dumb. They seem fixated on making (and reiterating) the same (losing) arguments - that's the definition of insanity.

The dissent in the 11th Cir is correct, best as I am aware - the court could have gone on and done a de novo review despite the fact that the Sincidler's lawyers didn't really ask for one. That being said, it wouldn't have been reduced to a mention of a dissent if THE LAWYERS DID THEIR JOB!

Terri Schiavo has had terrible lawyers looking out for her at almost every step of the way. While the judges have stunk, also, blame rests as much with her shoddy lawyers who don't seem to know much of what they are doings.

And as far as the Schindlers are concerned, they showed some poor judgment also. Randall Terry as a family adviser and spokesman? That's no way to build consensus - he alienates many people before he even opens his mouth.

This is not only a legal battle but a public relations battle - the Schindlers have consistently dropped the ball with their questionable judgment calls of family friends like Terry and much more importantly the legal mouthpieces they have chosen during this terrible tragedy.
