Gov. Bush: I can't help Terri Schiavo
CNN ^ | March 27, 2005

Posted on 03/27/2005 11:39:47 AM PST by El_Doctor

Rick Barnard of Morris, Illinois, wass arrested Sunday after trying to bring Terri Schiavo Easter communion. per cnn... ALLAHASSEE, Florida (CNN) -- Florida Gov. Jeb Bush said on Sunday there is nothing else he can do to save Terri Schiavo's life. "I cannot violate a court order," Bush said after returning to the Governor's Mansion from Easter Sunday church services. "I don't have powers from the United States Constitution or -- for that matter from the Florida Constitution -- that would allow me to intervene after a decision has been made." To Terri Schiavo's parents -- who have said Bush should do more to help their daughter -- the governor said: "I can't. I'd love to, but I can't." The governor has been under public pressure from Bob and Mary Schindler, parents of the 41-year-old brain-damaged woman, and many religious groups to intervene further in the case. On Thursday, a Florida state judge denied a petition by Gov. Bush and the state Department of Children and Families to take Schiavo into state custody. (Full story) The Florida Supreme Court dismissed on Saturday -- for the second time in a week -- an emergency petition by the Schindlers to have their daughter's feeding tube reconnected. "I'm sad that she's in the situation that she's in," Bush said, commenting publicly on the case for the first time since Thursday. "I feel bad for her family. My heart goes out to the Schindlers and, for that matter, to [her husband] Michael [Schiavo]," Bush said. "This has not been an easy thing for any, any member of the family. But most particularly for Terri Schiavo."

Well that is a shame, and I am sorry that you felt the need to throw a couple of unprovoked insults.

Other than that, God Bless and Happy Easter!!

Gads…again…Terri is the product of the Executive Branch (The Office of the Governor) having allowed the judicial branch take over the duties of the EB. (Thank you, Governor Bush, for your lack of you know what.)

You haven’t been reading and educating yourself. Terri is the product of this awful situation.

Read!!!

"EXECUTIVE BRANCH

The EXECUTIVE branch is the law-administering and law-enforcing branch of the government. It is patterned along the lines of a large corporation with the governor serving as chairman of the board and the three independently elected cabinet members serving as directors. The governor is elected for a four-year term and may serve two terms in succession. The lieutenant governor is elected as running mate of the governor. Members of the Cabinet are elected to four year terms and may succeed themselves for any number of terms. All of the many agencies and departments that are responsible for programs in Florida State government are also part of the Executive Branch.

The Governor is responsible for day-to-day operations of the state and is the chief law enforcement officer. The governor appoints not only the heads of departments under sole oversight of the governor, but also the heads of departments that are under both the governor and Cabinet's oversight, although at least three Cabinet members must agree to the appointments. The governor also appoints members of several regulatory boards and commissions.

By executive order, the governor may suspend from office any state or county elected official who is not subject to impeachment. The governor cannot suspend the lieutenant governor, Cabinet members, Supreme Court justices, appellate judges, or circuit court judges. They can be removed only by legislative impeachment.

Thought this might be interesting, it's found here:

Interestingly, it seems that Bush could have suspended the local sheriff if he defied his orders to stand down...

I wish he would have had the guts of that little 10-year-old fella, who walked right up with a cup of water for Terri.

I wish I had done what that kid did too. I should have cancelled a day's plans and got on a train.

Guess what branch of government state law enforcement belong to?

Absolutely right. People apparently are forgetting that the word "govern," as in "governor," is synonymous with "police."

I conceded earlier that many think the judicial branch is God...that's for sure.

However, that doesn't mean that that should be justification for thinking the executive branch is God, which is also wrong.

"No, they don't. Local police officers and sheriffs do not answer to him. They answer to local officials and the courts."

You are wrong, they do not answer to the courts (for crying out loud, the executive branch is ruled by the *executive*, not the judiciary!), and they are not independent. Are you really meaning to tell me that states are a confederation of counties? What local constitution do county police officers enforce, may I ask? How does a county go about petitioning for membership to a state?

Your assertion is absurd. The American constitution reserves powers to the federal government and to the states ONLY. Read it. There is no power reserved for counties, or cities, or any other subdivisions. States excercise absolute authority over their localities and the people of those localities except where prohibited by federal law, which supercedes state law.

There is one executive branch in the state of Florida and Jeb Bush is chief. Please point me out to the article of the U.S. or Florida consitution that would provide for another, indepedent executive. I'm waiting.

"Saying that Jeb, because you or someone else says so, should go beyond that and order officers to shoot other officers to save one woman is unreasonable."

Yay, for strawmen arguments! Do kindly direct me to where I said anything of the like.

As I have established, the officers in question are under Jeb's authority. If they refuse to respond to executive orders, they should be decommissioned as officers. I don't see where shooting them comes in.

"People act like Jeb could stop all of this. He couldn't. He didn't even have the backing of the state senate. It would have a been a disaster."

Disaster or not, all I'm saying is that it is within his executive capacity.

"Stop acting like this is some kind of computer game where you can just order people around. "

I have news for you, it's Jeb's *job* to order people around, and if you refuse to recognize the extent of his executive powers than you are simply being willfully ignorant of reality.

"There are laws to follow and even if you want to overrule a court, you have to have more people with you than just you and some state police. When the legislature, the people themselves (who would have disapproved of a firefight over Terri), and the courts are all against you, its time to back down."

First of all, you don't back down from what you think is right, regardless of whether the entire rest of the world is against. Second of all, when I have I *once* argued that Jeb *should* act in defiance of the courts? All I've argued is the simple fact that he has the power as governor to intervene.

"I would to do it in a flash if I were a resident of Florida and were an elected official."

Ah Ha!! The old "I would do it if.....blah, blah, blah..."
but you're not, so behind the trusty keyboard you're a 250pd. built like a "brick you know what" stud who has everyone in Pinellas Park thanking their lucky stars that you're not a Florida resident...

If that article is correct about the 1999 law, the President is going to be really steamed up at Jeb. Little brothers always seem to cause trouble for the eldest.

BTW...do you have to live in Florida in order to go there and demonstrate?

No, I don’t live in Florida. I was in enough demonstrations against Noriega...shot at and teargassed...the whole bit. It was lots of fun but it didn’t change anything. What I learned from that experience was that it takes high profile opposition leaders to make a change. Therefore, Bush, as governor, failed to turn this terrible problem around. He failed in his duties.

Can a Governor violate a court order? Is this overstepping his power.

At the time even of Marbury v. Madison it was overstepping the judiciary power to ISSUE such an order. But meanwhile everyone just got used to it.
