Gov. Bush: I can't help Terri Schiavo

Rick Barnard of Morris, Illinois, wass arrested Sunday after trying to bring Terri Schiavo Easter communion. per cnn... ALLAHASSEE, Florida (CNN) -- Florida Gov. Jeb Bush said on Sunday there is nothing else he can do to save Terri Schiavo's life. "I cannot violate a court order," Bush said after returning to the Governor's Mansion from Easter Sunday church services. "I don't have powers from the United States Constitution or -- for that matter from the Florida Constitution -- that would allow me to intervene after a decision has been made." To Terri Schiavo's parents -- who have said Bush should do more to help their daughter -- the governor said: "I can't. I'd love to, but I can't." The governor has been under public pressure from Bob and Mary Schindler, parents of the 41-year-old brain-damaged woman, and many religious groups to intervene further in the case. On Thursday, a Florida state judge denied a petition by Gov. Bush and the state Department of Children and Families to take Schiavo into state custody. (Full story) The Florida Supreme Court dismissed on Saturday -- for the second time in a week -- an emergency petition by the Schindlers to have their daughter's feeding tube reconnected. "I'm sad that she's in the situation that she's in," Bush said, commenting publicly on the case for the first time since Thursday. "I feel bad for her family. My heart goes out to the Schindlers and, for that matter, to [her husband] Michael [Schiavo]," Bush said. "This has not been an easy thing for any, any member of the family. But most particularly for Terri Schiavo."

No one said he was infallible, but I'd be willing to bet that he knows more about the law than most here.

I'm sure there are differing opinions on the law in this case, but whatever legal advice the Bush brothers are getting (and my guess would be it's top-notch), they don't believe they are within their authority to act.

Larry Klayman may think they are, but a lot of other people in the business apparently don't.

The entire Constiutional order in this country, including Florida, has been torn asunder by the judiciary, WITH the acquiescence of the executive and legislative branches.

What we see in Pinellas County, Florida is simply another manifestation of this.

This would never be permitted to happen if the American people were virtuous and demanded a stop to it. They have not (yet).

God works in mysterious ways. Life on earth is not pretty.

Can a Governor violate a court order?

Each branch has a responsibility to respect the Constitution and our nation's laws, but the executive has a particular responsibility to respect the Constitution and laws in the press of events as they occur.

Bear in mind that the judicial branch is concerned primarily with preserving justice -- the correspondence of our lives to the Constitution and the laws -- in the past. The judicial branch is primarily retrospective.

The legislative branch is concerned primarily with prospective justice -- conceiving and enacting laws that will perfect the society's pursuit of justice in the future.

But the executive is pre-eminently concerned with ensuring that the political community respects the law, the Constitution, and the fundamental principles of that Constitution, in the only moment that really exists -- the present. The executive acts, he does not judge what has been done, or consider what should be done in the future.

If the executive deems that something is occurring now -- whether by mandate of the court or not -- that violates that basic premises of the Constitution, he is bound by his oath to take action. Acting is what executives do.

Did you understand that?

To which I might add: the Pinellas County Sheriffs are in rebellion against the state of Florida. They asserted that they would "stop" the DCF from doing a job which is specifically empowered to them by the state law. And doing so under the authority derived from the governor's office - the state Constitution spells that out.

But they were determined to do that. I half-jokingly noted that this was Greer's army vs. the governor's army. But in fact, that is exactly what went down. Sabers were rattled, and the governor backed down.

Besides, I'm not an ordained minister and haven't sought to become one.

I think the true smokescreen is having to engage someone about the choice of my username. It's completely irrelevant as you have no idea what it signifies or if it signifies anything at all.

That's right. The executive.

I don't see why are you are accusing me of being unreasonable. I'm just stating facts, bro. Every non-federal officer in Florida answers to Jeb. And he can choose not to enforce court rulings, just like a cop can choose not to give you a ticket when he pulls you over. The courts can't do diddly about that--it's the legislative branch's job to check the governor. If they think there is grounds for it they can impeach him. But there's no court in Florida that can usurp Jeb's authority over law enforcement. Checks and balances, bro.

Perhaps you need a bit of soothing tea, some quiet music going on, and perhaps a bit of chocolate, to get back into your zen peace-is-all frame of mind.

I appreciate your articulating your beliefs, though. And you appear to have had an interest in the hearings. That's always an excellent indication that a person intends to stay informed.

Interaction is a good sign of a developing society.
