I'm sorry, but that's not the law. The guardian is supposed to make the same decision the incompetent would make if they were able to make it.

The guardian DOES have certain responsibilities under the law, and there is enough evidence that Michael did NOT carry out his legal responsibilities as her guardian that he should have been removed. It is incredibly barbaric to ASSUME that the AUTOMATIC choice any disabled person would make is to die. All that crap about this being what Terri would want if she could speak is just sugar-coating for the fact that this case is about setting a precedent that there is a certain level of ability below which a person has no legal standing as a person, and thus has no rights.

Anyway, what is your solution?

My solution is so simple, and the only one that makes moral sense. Let Terri's parents take care of her, as they have wanted all along. Grant Michael a divorce.

You want to know why I hate the legal system? It is because of things like this, where lawyers and judges do whatever they want, regardless of the morality, and then twist and interpret laws to support whatever immoral things they are doing. While they are playing around with making the law mean whatever they want it to mean, they completely forget the reason we have law to begin with--to protect our rights, to protect us from those who would do us harm, and to dispense justice to those who have harmed us.

You make a good point, but courts did not agree with you.

I don't assume that and neither do most thinking people. The goal is to make the decision that she would if she were competent.

I disagree with you. Making that decision is the most important responsibility a guardian has.

Your solution is not simple at all, because it ignores how it were to be enforced.

Michael Schiavo fits the traits of an abuser. You can even see his brothers covering up his sins with their own sins of lying, to keep us from what they know. You see the anger. You see the control. The isolation of her from light, friends, family, church, therapy. The fornication. The adultery. The lying. The greed. The put ons for appearances' sake. The lack of self-control. The scheming. And the lying to the entire world.

I believe he has been verbally abusing her often these years, if only in her ears, where others can't hear. But she can. They found injection marks on her and an insulin vial in the trash after he was with her for 20 minutes, and her blood was tested and found at "almost flat." She almost died. And she can't communicate.

The more I watch her videos, the more I see. I do see the smile, the awareness of others, the following of commands,the trying and attempting, the actual enjoying of engagement, the energy and niceness despite her situation. She does not deserve to have AMERICA PUT HER TO DEATH.

She needs to be rescued TODAY!
