She should have been factored out, but she wasn't. This diabolical plot has been in the making for a long time. I don't have the reference, but the attorney from hell shopped for just the right Judge before making his move.

can a attorney ASK for a certain Judge??

Laws can vary from state to state, in California it is thus:
An attorney can refuse a judge the first time they are before him/her and they will be assigned a new one which they must accept.
But attorneys cannot ask for a specific judge.

I think the way this was handled, Polly, was that Felos asked to move the hearing to another county. TheEmpireJournal would have reference to this in one of Scoop's articles.

Not outright demand a specific judge, but there are strings that can be pulled, calendars to check, and clerks who are willing to do favors.
