Both Bushes just proved that underneath it all, they are really only cowardly politicians. Either one of them could save Schiavo, they just give lip service!!!
Then why haven't they been filed? Why didn't Gibbs bring up these points in front of the Federal Judge?
If Michael Schiavo broke the law then call 911.
MS is already, clearly, guilty of two misdemeanors, both 2nd class charges. All one has to do is take a look at Florida Statute on adultery and co-habitation.
Too bad no judge or other judicial body has gone after him for it.
He did not have to petition the court before removing her. I have no idea what possessed him, other than political expediency. The law states that the Department had to petition the court for a hearing within 24 hours AFTER (not before) the romoval of the disabled adult.
I am suspicious because the more I think about it, how could the governor have expected any other outcome with Judge Greer than what occurred? He knows what has been happening with the courts. Perhaps he wanted to be able to say "I tried".
Because they have all been appeals per the old case. Terri needs a lawyer FOR HER, not for the parents who have been wasting time.
The old case has been routed through each appellate court, and appellate courts do not review new evidence, they just make sure the procedure per case was reviewed properly by each judge.
It would be illegal for a private citizen to do anything other than encourage our leaders to act. The governor has the legal authority and has stated that he believes that this woman may not be in a PVS. He has also stated that he has the authority. I think some people just think that the governor should act on what he claims is an injustice. Our leaders are not above criticism.
This case has charges much greater than two misdemeanors, including corruptiion and fraud. It is my guess the US Justice Department will at some time bring charges, but it may not happen soon enough for Terri.
I agree - she has been denied her due process rights under the U.S. Constitution and her right to councel (GAL) as a disabled adult have been abridged.
Im not the governor or the president. They are cowards. Are you that naive to believe that they couldnt stop this. According to the constitution the judicial branch is to be the weakest branch of government. If they had any balls they would send the state troopers and federal marshalls and stop this. They are the commander in chiefs and could send in the law by executive order. Dont be a blind Bushbot!!
These letters are very interesting and certainly look like they give Jeb Bush some options. To a degree, he tried the option of having the DCF take custody of Ms. Schiavo. However, the attorney's letter indicates that the DCF would take custody and AFTERWARD, but within 24 hours, file with the Court. Instead, I think Jeb Bush filed with the Court (Judge Greer) first, and the Court said the DCF could not "have" Terri. Bush may have done it this way in an "abundance of caution", or---if I remember correctly---after Bush's press conference about the "DCF option", didn't Greer warn him not to proceed?
Anyway, the second letter about the possible criminal charges that could be filed against Michael Schiavo is particularly interesting. Maybe some of this is being discussed with Federal Judge Whittemore now. Or, maybe it will come up in the future, even after Terri's death. Perhaps some action should be taken now to try to prevent cremation.
I am not being critical of Jeb Bush because I think he and President Bush have done all that they think they can to help Terri Schiavo. I think both are very committed to "right to life" issues and both are very courageous. I'm sure that Jeb Bush has a team of attorneys counselling him on this matter.
