Johnnie Cochran and Supreme Court

WASHINGTON - Supreme Court justices suggested Tuesday that a disgruntled former client of famed defense attorney Johnnie Cochran Jr. shouldn't have been barred from protesting publicly about Cochran.

But while agreeing the injunction that stopped Ulysses Tory's protests was too broad, justices also grappled with how else Cochran could have kept Tory from picketing his Los Angeles office, lying about him and refusing to stop until he got money.

"It is clearly over-broad. Now what should we do about that?" asked Justice Sandra Day O'Connor.

Tory's attorney, Erwin Chemerinsky, said Cochran could have pursued monetary damages against Tory instead.

"It's worthless against a person who has no assets," said Justice Antonin Scalia.

"Is there anything he can get from the court other than a damage remedy? ... The answer it seems is no," said Justice Anthony Kennedy.

Tory retained Cochran after a 1983 incident in which he and an employee were fired at by law enforcement officers while exiting a fish market.

He grew frustrated when he felt Cochran wasn't doing a good job representing him, and started claiming Cochran owed him money, something lower courts disputed.

I have to share my Johnnie Cochran story.

Several years ago teams were practicing for the Senior Bowl. Bunch of young athletes doing their thing for pro scouts and lawyers of the sport persuasion.

Little did I know that Cochran even knew this little town in Alabama existed, but there he was surrounded by his 'posse', high stepping onto the football field and swarming one particularly gifted football player, who I knew to be a good man as well as player.

I don't know what happened between Cochran and Shaun Alexander that day, but to see them together made me sick to my stomach.

As Cochran and his posse exited a quiet chant began "Nicole, Nicole, Nicole". He smiled and waved a royal wave at the people. I have it on tape somewhere.

That's my Cochran story.
