What there is not is a way for the Executive to simply override a judicial decision. There simply is not. If there were, we would have a different system of government than we have. Our Constitution would no longer apply.

If it were possible for the Executive to simply override a judicial decision, then we would have a government similar to Sadam Hussein's Iraq.

I remind you that Clinton used an executive order and the Dept of Justice to remove Elian Gonzalez from his relatives in Fla. Presidents have used the military in many ways without a declaration of war from Congress. So the power does exist in the Exec Branch.

Yes, and this is a point being conveniently ignored by the "save Terri at any cost" crowd. I can't believe I'm hearing so many people who are willing to throw away our entire system over this one person.

After this is ended, it will be time to address the questions through legislation.
