I'm not a lawyer, but it seems Gibbs has been "out-lawyered" in this case. One of the legal talking heads last night said the papers filed at the SCOTUS had "very confusing language" and it was obviously a rushed document. That is not a good way to do business when somebody's life is in the balance.
