I agree...the Schindler's need better lawyers.
The Shindlers lawyer handed Terri up to judge Greer as a PVS. Terri herself could have done a better job than that lawyer!

You're absolutely right and this is absolutely the point. We have made some people's lives more inherently valuable than others. Illinois will also get further in my NCAA bracket, but does that make Luther Head an inherently more valuable human being than a bench-rider from Wisconsin-Milwaukee?
More irony, is that Terri's settlement money for therapy and rehabilitation was used to hire that high powered shark attorney Felos, and Greer signed on it that it was okay for Michael Schiavo to use the money for the lawyer.
The clip of Felos saying that everyone "should be very afraid" of the government getting involved makes me very afraid that Felos is involved and who did he have up against him, the Schindler's lawyers who are like little bleeding guppies swimming amongst killer sharks!
Another way to state the point you make is that every judicial ruling since Congress passed the new law
has flatout refused to give her the de novo hearing the law requires them to give. The burden of proof they place on the Schindler's to show likelihood of prevailing first, is a giveaway.
They have to be basing that on the official trial record of Greer, but the new LAW says they must not defer in any way to the record but must give a trial de novo. Further, the new law implies that the feeding tube must be reinserted because everyone knows she will die without it, and a new trial would take time. That fact has been ignored at every step.
Those blaming the lawyer, and he may well be blameworthy, fail to note what the Statute clearly says the courts must do, which they have refused to do. The courts can read the text of the LAW; they don't need any good lawyering to help them.
This is unchartered territory. The framers of the constitution anticipated nastiness among the three branches, or else the system of checks and balances would be a system of "cordial deferments" instead.
That said, the executive branch has the moral impetus to ensure protection of citizenry under the constitution. Otherwise, there would be no reason for an executive branch. We could be ruled by legislatures and judiciaries who can hold unending pissing matches with no army to be led by either.
IMHO.
If the USSC decides not to hear the case or does hear it but rules against the Schindlers and, at that time, if all the folks standing outside the hospice and writing on threads such as this one in support of Terri don't rush in and at least try to stop what is going on then all the nashing of teeth and cries of condemnation against the President,his brother, et al. will be viewed as empty rhetoric and will diminish the 'culture of life' argument in future cases.
If folks are truly, truly incensed by what is going on then they, you, had better be prepared to back it up with action and face the very real risk of jail.
At what point do your convictions waiver?
When this is over, Greer and his ilk are going to be perp-marched off to jail when the stench of that hospice lifts to reveal some very ugly corruption going on.
Has anyone in Florida questioned why Terri would be in hospice to begin with? Hospice is strictly - STRICTLY! - for patients who are TERMINALLY ILL and have less than six months to live. TWO DOCTORS must sign off on papers admitting a patient to hospice, vouching for the terminal condition and prognosis of life expectancy. THERE WERE NO DOCTORS who signed off on Terri entering hospice. Why? BECAUSE SHE DIDN'T BELONG THERE IN THE FIRST PLACE!!
Do you see where I'm going? Who ON EARTH allowed Michael Schiavo to have Terri at a hospice where he could have tight control over Terri's treatment - when she's NOT A CANDIDATE FOR HOSPICE!!!? Hmmmm... I wonder WHO ELSE was going to get a piece of that settlement once "that bitch" dies!
When this is over - forget about feeling guilty about Terri being starved to death - the people who are supporting this execution are going to be faced with a revolting exposition of some of the most heinous criminal negligence and conspiracy by healthcare officials, lawyers, and judges in recent memory. Mark my words. There are three nurses with sworn affidavits the Micahel Schiavo wanted her dead from DAY ONE - ONE WITH A POLICE REPORT - stating that Michael Schiavo left life-threatening notes on the windshield of one nurse who was getting a little too concerned for Terri's welfare.
I'm just beside myself.

I understand your point perfectly. It's a valid question, but at the same time, we have raised the public consciousness of this case long before the MSM clued in. I don't think we should pillory the Brothers Bush, no sir. No one would relish their position. But don't write off the torrent of prayers, fasting, letters and phone calls to politicians, radio and television interviews and expert testimonies that have been generated just by writing on threads. We are doing everything imaginable to empower the political establishment to do the right thing at minimal political risk. Legislatures have made laws since time immemorial without necessarily having a vociferous population in support. We've created the climate where Jeb Bush can believe he has the moral authority to have DCF take custody of Terri - we've created the climate where President George W. Bush can leave his Crawford ranch and rush to Washington to sign a three a.m. bill on behalf of a formerly nameless, faceless Florida housewife - the leader of the free world! This hasn't gained worldwide attention because Peter Jennings spat his venom on the subject - it's gained worldwide attention because of people writing on threads and in blogs and in chat room forums.

Gibbs is doing a great job. He is even a good spokesperson on TV. I'm sure he has been working 24/7. He is up against the powers of darkness.

OK, neither of you have apparently paid any attention to the filings. Despite the fact that the legislation passed by Congress allowed FULL REVIEW by the federal courts, there was NO MENTION of it in the federal filings. Basically, the attys submitted the same appeal they've lost serval times over in state court rather than actually use the new legislation. Every lawyer and legal scholar, both pro-Terri and pro-Michael have said that it was a HUGE oversight on the part of the family's atty.
The filing tot the Supremes contained language that stated "in the event that the legislation passes". No competent atty would file with the Supreme Court and not mention legislation that had already passed THREE DAYS before.
So, I understand your point. But I respectfully disagree.
Well, with all due respect, it seems to me that your saying that you commitment to the life of one Terri Shiavo ends at the end of a keystroke or on the sidewalk outside of the hospice.
My point is, how many are willing to take it farther than that?
How many are will to rush the police around the hospice in an effort to prevent Terri's death?
How many are will to risk jail or maybe even being shot themselves in order to try and save Terri?
If these things don't take place when all else has failed then, at least where Terri's life is concerned, all the impassioned pleas will have done nothing.
Is this really about Terri? We shall see.
I was thinking the same thing the other day. I thought Hospice was for terminally ill patients....why was she there? In my opinion, Hospice 'made' her terminally ill if she dies.
