DCF Considers Removing Schiavo from Hospice by Force

State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.

Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'

Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'

Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.

'We're not compelled to look at prior judicial proceedings,' Hadl said.

What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

I was listening to Hannity's program for the few minutes I had to drive home. I don't know who the guest was. But he said, a judges job is to always look first to the Constitution then to the law.....and if it is unclear, he is to always bring the intent of the law in line with the Constitution; he is not to MAKE LAW.

Then WHOSE police are enforcing Terri's death ordeal?? I didn';t know the Judiciary had any except process servers??

Up to this point the Executive branch is defering to the Court, as it should do. But the governor can turn that on a dime. That is the issue. Will he? We are waiting only for SCOTUS now.

One would think it would be well known that she's not brain dead. But I heard a caller on a talk show today arguing that Terri's brain dead -- that her brain waves are flat! Some news outlet(s) must be reporting it way.

It amazes me. Bill Clinton pardon drug dealers and Terrorists and our own President doesn't have the b.... to commute the sentence on one helpless handicap woman. What is my son fighting for???

There is one little problem with the pardon situation. Terry has not committed a crime.Only criminals can be pardoned from punishment.

Under the law what is happening to Terry is not punishment. She has not committed a crime.

Terry is under the control of a guardian. Here guardian is her husband. No President or Govenror has the power to appoint or remove a guardian. Only Judges can do that. No president or Govenor has the power to overrule the decision of a guardian. Only the courts have the power to remove or over turn the decision of a guardian.

Her husband got the courts to give him the power kill her. He is exercising that power.

A pardon has no meaning in this case. One can't pardon someone who has never been convicted of a crime.

When our nation was founded the power over our lives were put into the hands of the judges. That is how our nation works. You may not like it, but kings and dictators have always had control over subjects life and death. The one thing our founders demanded was that our constitution not give the power of life and death to the president or any governor.
