DCF Considers Removing Schiavo from Hospice by Force
Palm Beach Post ^ | 3.23.05 | Dara Kam

State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.

Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'

Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'

Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.

'We're not compelled to look at prior judicial proceedings,' Hadl said.

What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

Might does not make right. The reason Jeb Bush should act is because saving a woman from starving is right, and he has the power to do so. The reason a President should not issue an order to have an abortion done, is that abortion is the killing of an innocent person.

The hypocrisy of Freepers demanding action in violation of court orders is appalling.

I'm sure Britain's courts help up the "legality" of the stamp act, but the Founders threw off the tyrrany of England anyhow.

This is not a "rule of law," this is judicial tyrrany. To NOT act is supreme cowardice in the face of these tyrants in black robes, tyrants no different than those we rejected when we founded this nation.

lex mulla, lex nulla.

If you can't see the ridiculousness of that statement you are beyond hope.

Between what should happen, and what the SCOFLAws will do, is another question.

That's a fact. My eyes were opened in 2000 when they deliberately cherry-picked and twisted the plain language of FL election statutes. Florida courts are a cesspool in my opinion.

That's a wonderful, non-hysterical way to put it. Within legal means while being humanitarian.

Where's a Papal army when you need one?

You know, robes ah' flowin', slitin' throats like the old crusades.

After all, we have God on our side. It doesn't even matter if we kill ah' few of dem unbelievers - just to get to her.

What order exactly would they be in contempt of?

The one placing her in that Hospice in the custody of her husband and ordering the feeding tube removed. The order that has been appealed all the way to the Supreme Court and affirmed all the way.

Felos is hilarious. Assault and batter charges against anyone who touches Terri - while she's being starved to death. That's funny. Felos better shut his trap.

I wish the DCF would order that Terri's death march be discontinued forthwith and that hydration be started. RIGHT NOW!

Go, Gov. Bush. Oh, and I'm sorry about all that nasty stuff I said about you a little while ago.

Who can we call now? It is 6:00 eastern time.

I just tried the Gov's office and the DCF's office.

The Gov's office says "call back later", the DCF allows a message to be left.

WHAT CAN I DO ???

b)This is a show down, literally, of the judiciary and the executive branch.

It's definately not this option. The judges just do the "wet work" for the legislators, so that their hands can stay clean for re-election.

On what grounds? His rulings have been upheld on appeal more than once. In fact, this case has been all the way to the supreme court...twice!

Do we arrest every judge that issues rulings we don't like?

Where are the Schindler's? FINALLY some hope for them. I couldn't handle it when I saw Terri's Mom pleading and crying. What a nightmare but apparently and hopefully it's just about over. And there won't be any more attempts on Terri's life.
