PINELLAS PARK, Fla. (AP) - Their options dwindling after two failed federal court appeals, Terri Schiavo's parents and brother vowed Wednesday to take their fight to the U.S. Supreme Court and state Legislature as the brain-damaged woman was in her fifth day without a feeding tube.
Gov. Jeb Bush renewed his call for the Legislature to step in and ``spare Terri's life.''
In a 2-1 ruling early Wednesday, a panel of the 11th Circuit Court of Appeals in Atlanta said the parents, who have battled with son-in-law Michael Schiavo for years over the woman's fate, ``failed to demonstrate a substantial case on the merits of any of their claims'' that the feeding tube should be reinserted immediately.
``There is no denying the absolute tragedy that has befallen Mrs. Schiavo,'' the ruling by Judges Ed Carnes and Frank M. Hull said. ``We all have our own family, our own loved ones, and our own children. However, we are called upon to make a collective, objective decision concerning a question of law.''

Here's an interesting story.
The execution was halted late Tuesday by U.S. District Judge Terry Means in Fort Worth.
Means was acting on an appeal from Staley's lawyer who argued the convicted killer is mentally incompetent and should not be put to death.
"Judge Means' order was that nobody's ever heard this guy's competency question," attorney Jack Strickland said.
As much as I hate to say it they are making the right judgement based on the law.
It's the law that needs to be changed.. and I'm afraid it's just going to be too late for Terri.

He not only authorized the removal of a feeding tube,he specifically denied her any sustenance by mouth of water or food.

Are you saying the people who are there don't believe in trying to protect Terri,or that childdren of 9 or 10 are not able to make a moral judgement?
If that's your beef go into any school and see what they are being asked to do everyday,campaign to save this critter or that one or the environment bla bla bal! Go to malls knock on doors. They can certainly do something special with their parents to save a poor woman's life.
I don't know. I think it's bad when liberals use children for media purposes, so why wouldn't I think the same in this case? Or, should I be inconsistent, and say "Well, it's ok to use children like this THIS time, because I believe in the case, but don't let me catch the liberals doing it..."?
It's not like the parent didn't know what the result would be, they knew alright... makes great telivision, doesn't it? And what did it accomplish? Nothing. Period. Nothing changed.

Anarchy is when the courts refuse to apply a very specific law created in this matter and disregarding their constitutional duty to apply the law.
Whether I would want to is irrelevant. We don't know her wishes, and by the law her husband should no longer have standing as a guardian, even if he were the nicest guy on Earth.
I wouldn't, in fact I've told my wife on numerous occasions, that if I were ever in a vegetative state, to please pull the plug.

I wish you'd left us your real name, so that when your wife denied you even a modicum of medical care, opposed tests that would determine beyond doubt whether you could recover, and planned to have you cremated immediately after death, we could all say, "Well, he told his wife that this is what he wanted," and let her murder you. BTW, how does your little missive to your wife mean that we should believe Terri Schiavo meant "Make me die slowly and painfully, even if it looks like I could live a normal life with proper treatment" when she told her husband she wouldn't want to be kept alive by a machine? If she really meant that, she was way, way insane and not competent to make the decision. Isn't it a pretty big legal leap to decide that somebody wished to die slowly and painfully? Can that possibly be a reasonable assumption?
And who's our evidence that she said it in the first place? Michael Schiavo, the guy who maintains this timeline as the truth (note, this is all from Michael's court testimony):
Late 80's: Terri says, "Pull the plug"
1990: Terri collapses.
1992: Michael promises to care for her for 50 years if necessary.
1993: Michael stops rehab, euthanizes her cats, melts down her wedding ring and tries to deny her anti-biotics for a urinary tract infection.
1997: Michael suddenly remembers that whole "pull the plug" thing, seven years after she was first brain damaged and on a feeding tube, and 5 years after he promised to care for her in that state for a half-century if necessary.
But hey, if we don't think that makes sense, it must be because we're religious zealots, right?
If you want to turn you're pro-life energy somewhere how about not supporting a pro-war foreign policy that results in the death of 1500 Americans and countless numbers of innocent civilians.
If you're so much for human dignity, why do you oppose the liberation of a country where people where raped as an interrogation technique, and executed by immersion in nitric acid? If you're so much for self-determination, why don't you respect the choice of those 1,500 troops, every one of whom volunteered? If you care about all those dead civilians (countless my tuchis, have you been watching Al-Jazeera?) why didn't you care about the 2 million people killed by Saddam's wars, terrorism and torturocracy?
In other words, you respect human dignity, adult choices and the right to live without being tortured or murdered--but only when it suits your politics. Go back under the sink and tell the other cockroaches that we didn't buy your propagandistic bilge.
I saw that this morning, read it to my husband, and he says my problem is my vocabulary has not expanded in 30 yrs. and I fail to realize my antiquated definition of a word can mean what I think it does, BUT it may mean the opposite as well, depending on who says it. I guess I need to go back to school and have my "brain washed" and be properly indoctrinated.

Same here Fairbanks - as much as I want our "Cowboy President" and Jeb to actually ride in and rescue Terri....they have sworn to uphold the laws. Our enemies would have both impeached in a new york minute. I feel certain Pres Bush has had Gonzales researching the laws about this very option.
I can take no comfort that a murder is being commited.

Well...see...there ya go. I don't think of it as murder. I think of what you and others have been putting her through for these many years as very cruel.
