Circuit Court Denies Schiavo Request

The 11th Circuit Court of Appeals early Wednesday morning denied a request by the parents of Terri Schiavo to have her feeding tube re-inserted.

The three-judge panel of the 11th Circuit Court of Appeals ruled 2-1. A federal judge in Florida also refused an appeal Tuesday morning.

Schiavo’s parents, Bob and Mary Schindler, vowed to file another appeal Wednesday, presumably with the U.S. Supreme Court.

"The Schindlers will be filing an appropriate appeal to save their daughter's life," Rex Sparklin, an attorney with the law firm representing the parents, told the Associated Press.

The legal battle over Terri Schiavo’s life shifted to Atlanta Tuesday as both parties in the case filed requests with the 11th Circuit Court of Appeals.

Schiavo’s parents have been locked for years in a battle with Schiavo's husband, Michael Schiavo, over whether her feeding tube should be disconnected.

State courts have sided with Michael Schiavo, who insists his wife told him she would never want to be kept alive artificially.

The tube was removed on Friday on orders from a state court judge. Congress passed legislation over the weekend -- signed by President George Bush -- that shifted the case to the federal court system.

Early Tuesday, U.S. District Judge James Whittemore of Tampa rejected the parents' emergency request under that legislation to have the tube reconnected, saying they had not established that they would probably prevail at a trial on their claim that Terri Schiavo's religious and due process rights have been violated.

A copy of the e-mails I just sent to President Bush and Vice President Cheney:

Dear Mr. President & Mr. Vice President,

From the bottom of my heart, I beseech you to do yet another extraordinary act of courage to save Terri Schiavo. The courts and judges(lawyers) are wrong. If Terri is killed, it will have far reaching implications upon the fabric of our American society. I realize it is 2005, but I did not grow up and was not raised in this culture of death that is being forced upon us by a minority of anti-Americans with no moral compass.

I strongly applaud your recent brave efforts to "err on the side of life". Unfortunately, Congress's message has fallen on the deaf ears of the pro-death cabal of judges(lawyers) and most certainly on Terri's very dubious "husband" who has refused to "take up his cross" and deal with what God has planned for Terri, who does not have a choice.

I implore you to take yet another bold and courageous act to save Terri, perhaps an executive order, at least until the truth is judiciously uncovered and sorted out. This is ridiculous sirs, she is being slowly killed without representation. Muderers and animals have more rights than Ms. Schiavo.

You have God on your side and he will guide you and be with you. Regardless of what your decision is sir, I will be praying for you.

Just the news I didn't want to hear. I am so horrified by all of this. I have worked in law for 20 years at the top law firms in the country. This is a travesty. This is vile and willful ignorance on the part of the judiciary. As I posted the other night my father was diagnosed with dementia and for a few years we thought he was barely cognitive until a new kind of MRI was done on him in around 2000 and we learned that the only part of his brain affected was his ability to speak and that all the rest of him was still there. Learning this greatly altered the way we interacted with him. Terri deserved further review and further testing. That would have been the highest justice. That is a great letter Racer and nice to see another RPV freeper on board.

There will be far reaching and irrevocable results for this.

Every judge, every attorney, every individual who has dipped their hands in Terri Schiavo's blood will not escape God, who will surely exercise HIS Supreme Authority over these individuals who have brought this evil upon us.

None of us will escape. We will be collectively judged as a nation for this despicable act, and while we ourselves may not bear individual blame for the death of Terri Schiavo, we will all suffer the consequences which will come about as a result of her death, as surely as the sun rises each morning.

Innocent blood is about to be shed, for no good reason, indeed - it is about to be shed for all sortsof evil motivations, some of which have been already exposed, some that still await the light of day.

The fact that the murder of Terri Schiavo is being pursued so feverishly, even as we approach the holiest days of Christianity, demonstrates the blasphemous nature of the perpetrators of this vile act.

America's continued existence as a nation can no longer be assumed. With this act, our so-called 'justice system' has abdicated any moral standing the United States might have had in the world.

From some point in the not-so-distant future, we will look back to these specific days and sadly conclude that this was the trigger for the desolation and destruction that is looming ahead.

Every American should be hanging their heads in shame.

I know I am.

"Our dissenting colleague says that “the denial of Plaintiffs’ request for an injunction frustrates Congress’s intent, which is to maintain the status quo.”

Terri's Parents should bring Michael up on charges a lawsuit of any kind possibly of abuse and neglect immediately and then order the courts to restore Terri's nutrition since she is the prime exhibit to this lawsuit.

Something must be done NOW...

There was one Bush Sr. appointee, and 2 Clinton appointees. The one judge that dissented, was a Clinton one. Bet you didn't expect that.
