Fox just announced the appeal has been filed with the SCOTUS and regardless of the hour each Chamber is aware of it and they're probably talking if over now.
Good news, but such bad luck that Kennedy is the one who is over this district. Well, the Chief Justice is back from his sick bed (no coincidence me thinks) so hopefully Kennedy will not be able to totally quash it -- against the legislative intent for a new review -- that the 11th Circuit did.
