I just heard the same thing. I'm not an expert, the statutes don't say DCF has to get approval from a judge.
I think because this is a settled case and the judge has jurisdiction, the DCF cannot interfere without his permission. Otherwise why would they have waited when they knew very well that he intended to kill her? What "new evidence" is more serious than THAT?
