Apparently, the Schindlers' attorney filed his brief late. They missed the deadline for a couple of hours, but they could still get a hearing if the full court agrees.

Maybe the Schindlers' attorney(s) read your posts and corrected the omissions. Let's at least hope there was a good reason for their late filing.

Dammit, that's not how this works. An appeal cannot change the original plea. They have to file a new complaint in front of Whittemore if they want to start a new case. The case they are appealing is ruined. It's absolutely the wrong case to be pursuing. They will lose every time with that. They need to start over, not appeal. And they'd better hurry.
