There's a lot of work cut out for the Floridians to get their safeguards into law...and whereever we live, we need to double check and see if Terri's situation could happen where WE live...and work to see that it doesn't!

Another state (Michigan?) is preparing legislation at this very moment that would disqualify a spouse as legal guardian and decision-maker if adultery is proven. Makes perfect sense, as an adulterer would OBVIOUSLY not have his or her spouse's best interest at heart! (One of those "Duh!" issues that legislators are only now taking into consideration.)

We could probably draw up lengthy lists of "Duh!" issues that currently are not addressed in guardian issues, and strengthen wording in laws already on the books to further protect the incapacitated and disabled from abuse.

For a little eye-opening reading this morning, take a gander at this compilation of tricks being used, legally, by guardians raiding their wards' trust funds: "Dirty Tricks of Guardianships ‚ The Need for Change" by Robert W. Melton, Chief Auditor, Clerk of the Circuit Court, Pinellas County.
