But since then, the Congress passed that law and now it is/was in the hands of Whettmore (supposed to be de novo), so Moody's ruling is moot.

Yeah, what happened was that Gibbs tried to do something BEFORE the tube was removed (18th) and so just started filing motions and then the law was passed and so he started filing other motions....it can get confusing keeping up...here is a link to the district Court (Moody/Whittemore) so you can see the motion that Moody denied...http://www.flmd.uscourts.gov/ all you have to do is type notable cases in the search box then click on the link that is there (United States v. something) and then click other notable cases...you will see all the cases thus far, including Whittemore's, the third one down is Moody.
