I don't think you are being fair with Jeb. Both Bush guys are pragmatists and Jeb saw the writing on the wall on this. He knew how bad the judges are - heck he's been legally dueling with them for months. He knew it needed to go Federal or this nightmare would just continue for Terri.
Or, he could have unilaterally rescued Terri by fiat and let it become a test case to decide whether a governor's power to commute a death sentence should be a privilege of criminals only. An equal protection argument. But...that takes a leader.
