I think some of the state reps have no clue as to our court system! From all I have heard this would be a new case that Terri is allowed to bring versus Schiavo. She has never been able to do that and that violates her due process rights. I have heard on several reports that the court would be a federal district court (trial court)and that the court is in Atlanta GA, but I believe the 11th circuit (Court of Appeals) is in GA. But more than once I heard it would be a NEW case since Terri herself has never been permitted to file a claim on her behalf. It may be that the 11th would review what has already transpired and would see that her rights have been violated and would grant her the ability to take her case to trial...it would help if I could see the statute that was passed tonight, I have been searching but nothing yet.
