This judges comment to Gibbs about doubting the Schindlers could win was a bad comment. This is supposed to be a De Novo decision that isn't based on the past case and only on Info from today. It may be that the judge is confused as to what the Bill was that was passed.

It's not a good sign, you're correct. However, judges often give a harder time to the side they are leaning towards ruling for because they want to demonstrate they were fair in analyzing all the issues. I know it sounds like wishful thinking, but it really is common to see judges lean hard on the side they eventually rule for.
