First, there's the expost facto problem, only procedural laws and Clinton's tax increases can be retroactive.

Thanks for the humor (always needed). And I have also wondered about the "retroactiveness" of any type decision coming down (in that would it apply to Terri or just future cases down the road).

When the Supreme Court "passed" the law that no one under 18 can be put to death, it sure became retroactive.
