Senate Majority Leader Bill Frist said Friday that subpoenas issued by Sen. Mike Enzi compelling Terri Schiavo to appear at a March 28 congressional hearing made it a crime to disconnect her feeding tube - and threatened anyone who interfered with her testimony with jail.
In a statement issued by the majority leader's office, Frist said:
"Federal criminal law protects witnesses called before official Congressional committee proceedings from anyone who may obstruct or impede a witness attendance or testimony."
"More specifically," said the Senate's top Republican, "the law protects a witness from anyone who - by threats, force, or by any threatening letter or communication - influences, obstructs, or impedes an inquiry or investigation by Congress.
"Anyone who violates this law is subject to criminal fines and imprisonment," Frist said.
His comments appeared to be directed at Florida state judge George Greer, who brazenly defied the Enzi subpoena on Friday and ordered Schiavo's starvation to commence.
Frist's statement echoed comments by House Majority Leader Tom DeLay, who said late Friday that he intended to charge Greer with contempt of Congress.
"No little judge sitting in a state district court in Florida is going to usurp the authority of Congress," he complained.

This case is real simple to me. If Terri wanted to die, she should have put it in writting or at least told someone other than her husband.
Now we are being asked to believe the one person who really wants her dead to accept that these are her wishes. I have a hard time doing that.
As much as a great deal of right-minded civil disobedience would be great in the future for the right reasons ---- forget about it! There will NEVER be anything even like the incorrect anti-war protests in the late 60's and early 70's. People are just sluggish, lazy, and uninspired slobs. It WILL NEVER HAPPEN!

That didn't stop President Eisenhower from sending the National Guard in to protect black children from entering a school in Little Rock.
And I seem to remember federal institutions intruding on "states rights" a few other times too. Like when the Supreme Court overturned all state abortion laws in Roe v. Wade. And later, overturned all state death penalty laws (though SCOTUS reversed itself on that.) And, more recently, all states' sodomy laws in Lawrence v. Texas.

It is against FL state law for any judge to be the guardian of someone whose case he is involved in!!!!!!!!!!!!!!!!!

The judges abuse the Marshals, use them as chauffeurs and errand boys, and often ignore Marshals' recommendations to keep prisoners in handcuffs when they appear before Federal Judges. The judges often show little regard for the judgment of the Marshals, who know the behavior of the violent offenders whom they have tracked and apprehended much better than the judges do.
The Marshals also have a significantly higher rate of actually finding their suspects than the FBI - they are the unsung heros of the law enforcement world. The FBI usually takes credit for the finds the Marshals have made - a good example is the DC sniper case. FBI took credit, but a US Marshal who spent four sleepless nights on a computer actually tracked a vehicle down that everyone else had ignored and was able to issue the BOLO which lead to the snipers' apprehensions.

The penumbra of the constitution says Pres. Bush has the right to send federal marshals down there to save her. It is time we enforce the penumbra of the constitution.

How, then, can he assess the credibility of witnesses before him?
First, the concept of "rights" is based on individual rights. No one has rights, unless everyone has them. Second, imagine those who say that handicapped can be killed because they don't have quality of life deciding that they want to save money by testing all of the nursing home residents in the U.S. and withholding food and water from those who do not pass the test. If we were talking about millions of people starving this weekend rather than just one, would you conceed that the situation was political? With a lot of talk about tackling the expenses of Medicare and Medicaid next, we are closer to having a discussion of these ideas than you may imagine. Remember, the French just let 15,000 elderly dies while they went on vacation a couple of years ago.
