You're working awfully hard to try to excuse or dismiss facts. Did you READ that link? Did you SEE the Judge's order? He said it, and in no uncertain terms:

Well yeah, but he also said this is a duplicate motion, which he'll rule on in the other motion. This isn't a final ruling. It can't be. For one thing, it would be an illegal ruling. He can't forbid her to have food and water.
