Call your Congressmen! Support House Resolution 97. which would prohibit the Supreme Court from relying on foreign/international law or "opinion." This is VERY IMPORTANT, especially in light of this week's Supreme Court decision!!

Initially introduced by Representative Tom Freeney (R) of Florida last year, the bill was reintroduced in February. Contact your Congressmen to express your support for this bill and urge them to co-sponsor it!!

it's just very sad that we actually need a Congressional resolution to tell the SCOTUS that the Constitution, not international opinion, is the basis for our laws.

I think this would have to be a Constitutional amendment not to infringe on the separation of powers. Congress can't tell the Court how to do its job, only the Constitution can.

unless such foreign judgments, laws, or pronouncements inform an understanding of the original meaning of the Constitution of the United States.

I say "kill all the lawyers" first. Otherwise we will continue to get crap like this. What does it mean?

This "sense of the house" amounts to an opinion and is not binding. It does nothing. They should be drafting articles of impeachment. That would actually accomplish something.

Where does this resolution 'prohibit' the Supreme Court from relying on foreign/international law?... It is only a resolution expressing the sense of the House and isn't binding on the Court.

If they want to bind the legislation, etc then they need to explicitly state so in the legislation they enact.

If this bill became law would it invalidate past rulings by SCOTUS or any other court that cited foreign law or opinion?

No, No, NO!!!

The appellate jurisdiction of the Supreme Cout is subject to such regulations as Congress shall make, Art III, s2.

A sense of the House resolution is a spineless copout, and I wouldn't spend a dime or five minutes of my time promoting it.

Congress should not "express its sense", Congress should FORBID, by statute in the form of an Article III regulation, ANY use of ANY foreign court or parliamentary opinion in any adjudication before ANY US Court.

Nothing less will suffice.

Sense of the House (or Senate) resolutions are generally written and passed so they can avoid ding anything real, with teeth.

This is an empty pap for the masses.

Congress has the power under the Constitution to limit the jurisdiction of the Federal Courts. It's there in black and white and plain English. It's time for Congress to stop passing resolutions and start passing limitations.
