As well they should, because the 14th Amendment says that if you're born here, you're a citizen. Don't like it, amend the Constitution.

It would be hard for the Supreme Court to do that as Congress is given sole authority in the Constitution to set rules for citizenship.

Scotus would have to shoot it down. The Constitution is absolutely clear on this one, there is no other interpretation possible.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

Argue all you want, but you can't change that clear language "ALL PERSONS BORN" to mean anything other than all persons born.

Not likely; this is in an area where congress has full authority. It is a natural, since it relates to a criminal violation of out borders.

are you sure? they approved CFR.

They may see it as a way to capitulate to save themselves ala the FDR court packing scandal.
