Section 2 - Trial by Jury, Original Jurisdiction, Jury Trials

..... In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

Might be time for Congress to make some Exceptions or Regulations. Checks and Balances and that sort of thing.

Clever fellows, those Founders.

A few conservatives tried to do this with a law to protect marriage from the likes of Kennedy and his Sodomite pals. Our fearless Republican senators, under the courageous leadership of Bill Frist, let it die. Thus the Gramscian Republicans continue the long march to the left.

Frist's choice for the Senate Judiciary, Arlen Specter, along with his Marxist legal staff, will be the gatekeepers for all nominees to the Supreme Court - assuring that only those judges who share the views of Souter, O'Connor, Ginsburg, Stevens, Bryer, and Kennedys will be approved. Next time they're campaigning, Frist and the gang will talk up the need to re-elect them so they can "fix" the Supreme Court. Nice scam.

The Court would just find the Exceptions and Regulations to be unconstitutional. Only a Constitutional amendment can overrule them. That and the exercise of the second amendment, but I don't think we are quite there.....yet.

Constitutional change is needed to reign in the Courts. Probably remove the lifetime appointment clause for Supreme Court Justices and other federal judges. I'd have them appointed, with advice and consent, but then make them stand election for "continuance", as is done in at least one state.
