After a thorough review of Terri Schiavos case and seeking the opinion of legal counsel, I have concluded that Terri Schiavo is most certainly a victim.
There is a very real possibility that an act of domestic violence caused Terris present condition. On February 28th, I called a press conference on the steps of the Federal Courthouse in Jacksonville with the Schindler family and many other public officials.
On that day, 2 weeks ago, I asked Governor Jeb Bush to appoint a special prosecutor and the FDLE to investigate the origin of Terris collapse and also the numerous ongoing violations of Florida law which protect the rights of disabled citizens.
I have submitted this request in writing as Gov. Bushs spokesman requested, and the Justice Coalition is waiting for his response. The public has a right to know the truth regarding these criminal allegations and until they are investigated we will not know the answers.
Terri Schiavo has never received the rehabilitation her husband swore under oath to provide her. Michael Schiavo obtained over 1.5 million dollars as the result of a medical malpratic lawsuit.
Instead, Schiavo used the money earmarked for Terris medical trust to hire attorneys to end her life by starvation and dehydration.
Contrary to published reports, Terri Schiavo has not been given a swallowing test or medical rehabilitation since 1992. She has been held hostage in a nursing home and a hospice where she has spent the last 5 years.
Terri has been left for years to stare out a window, and more recently a darkend room, with the blinds closed as her parents fight to get her back so they can give her the proper care and medical attention.
This is clearly a violation of FL.S. 744.3215. Judge George Greer refuses to make the guardian, Michael Schiavo, comply with Florida law.
In violation of federal and state guidelines, Terri has been held hostage in a home for the dying, even though she is neither terminal nor dying. This deliberate omission by the mainstream media is a national disgrace.
The right to life is protected under the U.S. Constitution and has been fought and paid for in blood, down thru the ages from our Founding Fathers to this present day and is an inalienable right. This court ordered starvation death is no less than judicial homicide.
Terri has not been permitted outside except in emergency transport in over 5 years.
Under Florida law, if an animal were treated this way, you would be arrested and put in jail.
Under Florida law it is illegal to starve a barnyard animal or a convicted felon, as it would consitute cruel and unusual punishment. The state does not treat death row inmates this inhumanely.
We saw last Thursday, Judge Greer blocked by court order, the DCF, a state agency, from investigating the allegations of ongoing criminal abuse against Terri Schiavo by her guardian. Judge Greer's ruling violated the Separation of Powers Doctrine, which protects all 3 branches of government from encroachment.
Former Schindler attorney, Pat Anderson, requested an investigation into this abuse 2 years ago. Chief Counsel, Frank Nagatani, for the DCF, told her that the supervisors in the region had looked at the case, but simply were not going to get involved.
When Judge Greer states that these allegations have been investigated and the DCF found no abuse, this is a lie. In fact, we find that when Judge Greer had the other DCF notes and complaint sealed 2 years ago, he again obstructed justice for Terri by preventing the court to enter this information into the record.
Also, in violation of Florida law and judicial canon, Judge Greer has acted as the judge and Terri's guardian ad litem in an adversarial proceeding. This is statutorily prohibited and also a denial of due process.
With this in mind, we ask the Legislature and Judiciary Committee which meets tomorrow, as well as the Health and Family Council, which meets Tuesday, to act swiftly to prevent this injustice by enacting HB 701 into law.
Additionally, we ask the Senate to move immediately with the companion bill S2128 sponsored by Senator Steve Wise. In any event, we request Gov. Bush, by Executive order, to send the FDLE on Friday to Woodside Hospice to prevent the removal of Terris feeding tube, which would cause her an agonizing and painful death.
It will also destroy the only living piece of evidence into how and why Terri's bone scan reveals that she has a "history of trauma."
We ask that until all the criminal allegations have been thoroughly investigated, that Governor Bush take Terri into protective custody under Chapter 415.1051 of the Florida statutes.
I ask Florida lawmakers to contemplate Terri Schiavos life when they receive this rose. What will happen to this flower if it is deprived of water?
I believe that Terri Schiavo is the Ultimate Victim and therefore deserves the Ultimate protection.
