Yes, it is a mess. The death penalty is thrown out because of small technicalities. Our legislature wants to correct the problem; however, that might create a problem. The seven or so people on Kansas' death row are off the hook, pending appeal to the Kansas Supreme Court. If the lower court's ruling holds, they are commuted. If the legislature acts before the courts settle the matter, then all of the death row convicts get another trial at minimum.

The D.A. in Wichita, among others has requested that the legislature hold off on fixing the death penalty until the court can rule. This is the same D.A. that prosecuted the Carr brothers (five murders, four in a single incident).

The Carr case was one of the most wicked, cruel cases I have ever read about..
