PIERRE, S.D. - The second-degree manslaughter and reckless driving convictions of Bill Janklow, a former congressman and four-term governor, have been unanimously upheld by the South Dakota Supreme Court.
A decision released today said Janklow received a fair trial and there was enough evidence to convict him.
Janklow was found guilty of killing Randy Scott, 55, of Hardwick, Minn., when his motorcycle collided with a car Janklow was driving on Aug. 16, 2003, near Trent.
Authorities said Janklow sped through a stop sign at an intersection of two rural highways. Janklow has said he was in a diabetic stupor and remembers nothing about the crash.

All five Supreme Court justices disqualified themselves from the case because Janklow had appointed four of them while he was governor and had named a fifth justice earlier as a circuit judge.
It looks as if ALL members of the court disqualified themselves. If so how did the supreme court rule on his appeal? What am I missing?

(Photo courtesy of the Scott family)Randy Scott on his Harley Davidson motorcycle. Scott lived in Hardwick, Minn. He was touring the countryside with a friend when he struck Janklow's car August 16th.
Note this is Janklow's SECOND apppeal to the Supreme Court to overturn his conviction for technical reasons. A similar panel of appointed judges heard and rejected the first appeal.
He was convicted of manslaughter and served only 100 days in jail. According to jail sources he spent most of his 100 days on his cell phone and reading and refused to do any outside commnuity service. After a 3 year probation his felony conviction will be removed from his record!
