Oswaldo Martinez is facing murder and rape charges in the death of 16-year-old Brittany Binger.
As it turns out, James City County police had seen him before, having stopped him for DUI last year.
Police told us Martinez didn't have a driver's license, but his brother showed up at the scene and produced a Social Security card.
Martinez went through the courts system as a first time DUI offender, got a 90-day suspended sentence and a $250 fine.
Now, nearly a year later, police have linked Martinez, an illegal immigrant from El Salvador, to the teen's rape and murder.
Authorities went back to the DUI file and traced the Social Security number given by Martinez at the time. We're told it belongs to a white man in Texas.
Immigration officials confirm they had no record of any Oswaldo Martinez, meaning he's been in this country illegally for at least a year.
Police didn't have an answer for why they didn't further question the documentation when he was arrested for DUI.
A call to the Commonwealth's Attorney, asking the same thing, was not returned.

Conservatives are really big on justice, and convicting tens of millions of peaceful and productive neighbors because they all have the same skin color - or immigration status - is a crime against justice.
No it doesn't. But it is funny that with all the weak and lame attempts to harden our borders by the Bush Administration, one thing has come out of it. A crime wave in Mexican border towns. Even slowing down the influx makes a huge difference, and causes our neighbors all kinds of trouble that they didn't have to deal with when we accepted their problems.

No. But if the perp had been prevented from entering our country (ILLEGALLY) this specific crime would not have occurred. This is is an indisputable fact.

This criminal was here illegally. He violated US law by crossing the border without legal authorization. He then raped and murdered a young girl. This was after LE had more than ample opportunity to determine his 'status'.
You've come full circle CJ. You profess to despise libertarians, but you've become one of the biggest 'open borders' supporters on the forum. That's a pretty key plank of the LP, isn't it?
What's next for you? Are you going to defend people who smoke pot because that's discrimination based on their 'drug status'?
Wanting US laws on immigration enforced doesn't make anyone a racist. The next time you accuse me or anyone else of being a racist for wanting US laws enforced, I'll report you to the mods and request you be tossed off the forum.
