If some US publisher creates such a book and then sells a press run to some German fringe group who might re-sell the copies in Germany, then should the FBI arrest the publishers here for "conspiring" to break the law over there? It's convoluted

No, you can't be arrested for conspiring to commit an act that isn't illegal in the US. The FBI wouldn't arrest a group of Christians for "conspiring" to preach Christianity in Saudi Arabia.
