And your evidence that he was buying drugs illegally is what?

The list of drugs and the dates they were purchased was attached to the affidavit for the search warrant. The amounts and dates overlap and is prima facia evidence of doctor shopping, a crime under florida law.

It is not proven because the prosecution submits an affidavit. The defense gets to have an opportunity to explain the situation, including to deny athe allegations in the document supporting the warrant. The police offer is not the fact finder, the court is, after a contested hearing.

And yet...No charges have been filed. I wonder why. Could it be the case is so weak they couldn't get a conviction? Or is it that no one in Florida history has been prosecuted for doctor shopping? Or is it that their chief testimony comes from someone, attempting to blackmail him, with a long criminal history?

So the affidavit contained the "evidence" before they had the evidence? I don't think so. If they already had a list of the drugs and the dates they were purchased, why did they need the medical records? Where did they get the information for the affidavit?

It makes more sense to say they had a list of alleged drugs and a list of alleged dates of purchase. Precisely the kind of "information" a person should be allowed to confront and contest before his records are released toa partisan hack DA.
