I heard David Bossie respond to this issue. Apparently, it was discussed with CU's attorneys and there is case law establishing that, once they entered into the political arena, likenesses used in the political arena are not subject to copyright, etc. protections.
(No, I'm not a lawyer; I thought about going to law school, but sobered up before I could enroll.)
