Justice Arrested for Drunken Driving Asked Officer to Let Her Go
Published: Feb 6, 2005 COLUMBUS, Ohio (AP) - A state Supreme Court justice pulled over for drunk driving urged a police officer not to arrest her and cited her rulings in drunken driving cases, according to police videotapes.
Justice Alice Robie Resnick, 65, of Toledo, is scheduled to appear court Monday, one week after police pulled her over on Interstate 75 in northern Ohio. Her attorney, Sheldon Wittenberg, filed a request last week indicating she wants to change her innocent plea, but he did not say what the new plea would be.
In the video, shot by a camera on the dashboard of the patrol car and released Friday, a police sergeant questioning Resnick in the front seat tells her he can smell alcohol on her breath.
Resnick assures the officer that she can drive safely, but he asks her to take a portable breath-analysis test. She then lowers her voice and says, "I did have something to drink."
Resnick also repeatedly asks to be let go, saying, "My God, you know I decide all these cases in your favor. And my golly, look what you're doing to me."
Resnick's blood-alcohol content registered 0.22 percent, more than twice the legal limit in Ohio of 0.08 percent. However, the portable test cannot be used as evidence in court.
She refused to take an official Breathalyzer test, which means an automatic one-year license suspension and a three-year ban from driving state vehicles.
Resnick could also receive as much as six months in jail and a fine up to $1,000 if she is convicted.
Resnick later apologized in a statement. A justice since 1989, she is the court's only Democrat.

Statement from Justice Alice Robie Resnick
Justice Alice Robie Resnick of the Supreme Court of Ohio today released the following statement:
It is unfortunate that this situation has arisen after 22 years of sobriety. For that, I extend my regrets to the citizens of Ohio. The overwhelming outpouring of support and assistance during this difficult time has strengthened me to continue to do the important work of the Court.
On the advice of my attorney I cannot at this time comment to the media concerning the expected legal proceedings in municipal court. However, I will accept full responsibility for my actions.
I extend my deep appreciation to my family, friends, colleagues and especially the citizens of Ohio, who have always been supportive.

Judge Won't Face Extra Charges
A northwest Ohio prosecutor says he won't pursue any additional charges against Ohio Supreme Court Justice Alice Robie Resnick.
Bowling Green prosecutor Matt Reger had been considering whether to charge Resnick with failing to comply with a law enforcement officer's order after she drove away from officers.
Resnick was charged with driving under the influence after being pulled over in northwest Ohio on Monday.
Minutes earlier, the Supreme Court justice had driven off without permission after being asked to take a sobriety test. The prosecutor says Resnick shouldn't face any more charges because she was never told she was under arrest and the officers never made a lawful order for her to stop.....

Not good behavior. She should be punished for all her actions.
She might get 6 months to dry out.This would be good.
What does that mean?
Is she acknowledging that she is an alcoholic who was sober for 22 years but just fell off the wagon for the first time that Monday afternoon?
Or is she just saying that she hasn't been caught drinking and driving in 22 years?
Are we supposed to believe that she took her first drink in 22 years on Monday and was able to absorb that much alcohol without passing out?

So after 22 years of sobriety, she goes out and gets annihilated. More proof that time flies when you're having fun.
Rats always think we're stupid enough to believe everything they say; and yes, that's what I think they want us to believe.
LOL. I'd love to see a private citizen try to get out of fleeing from a traffic stop.
If you or I pulled that we would be up on a number of charges, including obstruction.
I doubt they'll put her away (she's a judge, doncha know). But I doubt that she will remain a judge....see other articles I found; apparently she also lied to other officers earlier that evening and drove away from at least one.
Absolutely we'd never get away with that kind of crap.....
