A disheveled Joseph Massino made his first court appearance in his new capacity as canary-don yesterday — where it was revealed the feds are trying to get him off the hook for the potential death penalty. Assistant U.S. Attorney Greg Andres indicated to a federal judge that prosecutors are seeking to spare Massino the ordeal of going to trial for a 1999 murder that could lead to the ultimate punishment.
