"The ACLU submitted a friend-of-the-court brief in the case on behalf of Roy Caballes, a 36-year-old Las Vegas resident who was charged with marijuana trafficking in Illinois in 1999. Caballes, who was en route to Chicago, was pulled over by a state trooper for driving six miles above the speed limit. While the trooper was issuing Caballes a warning ticket, a second trooper, who had not been called, arrived and began walking a canine unit around the car. The dog discovered marijuana in the trunk and Caballes was arrested and later sentenced to 12 years in prison."
I recall that the 9/11 hijackers weren't very nervous. I know how much you hate drugs but try to get a little perspective.
I'll bet the Troopers had advanced evidence and knew the guy was carrying but their evidence was either inadmissible or they wanted to keep it secret due to other ongoing investigations. So they tagged a canine unit behind the guy and just waited for him to make the slightest traffic violation. Bam - busted.
Makes one wonder if the air freshener was covering up a recent sampling of the trunk's contents. If a two-legged law officer's nose detects marijuana, is that counted as probable cause to search a car?
