Children Made Fatherless By Family Courts (Important!)
Eagle Forum ^ | January 12, 2005 | Phyllis Schlafly

One impressive vote last November second has been overlooked by the media. By 85 to 15 percent, a ballot initiative in Massachusetts approved equal legal and physical custody of children whose parents are divorced. That ballot initiative is nonbinding, but it certainly is indicative of the will of the people and the growing recognition that children are best off under the care of both parents. The initiative came out of the grassroots with a massive signature-gathering effort during the summer.

The proposition appeared on the ballot as follows: "Shall the State Representative from this district be instructed to vote in favor of legislation requiring that in all separation and divorce proceedings involving minor children, the courts shall uphold the fundamental rights of both parents to the shared physical and legal custody of their children and the children's right to maximize their time with each parent, so far as is practical, unless one parent is found unfit or the parents agree otherwise, subject to the requirements of existing child support and abuse prevention laws?"

Family Court [alleged] judges aren't usually "judges." They're "magistrates" which is a fancy name for a clerk. Find out if the "judge" that you're dealing with has the authority to issue felony arrest warrants. If not, slap your lawyer upside the head and demand a real judge.

Ballot initiatives mean nothing to the Ruling Class here in MA. Gay marriage was a ballot initiative too, I think, but we are the only state with gay marriage. See how it works?

Matt 5:32 But I say unto you, That whosoever shall put away his wife, saving for the cause of fornication, causeth her to commit adultery: and whosoever shall marry her that is divorced committeth adultery.

why should this be "impressive"????

the more ways society finds to allow families to break up, the worse our society is...

People used to stay together because of the children.....remember those days?

but now, we make it easier and easier for adults to break marriage vows and to have this tidy little arrangements such as this, where custody of children is "joint" or shared.....

baloney...

if we actually loved children and wanted a better society for them, we would make it harder for divorce to occurr, and make it doubly hard on parents ....

if people knew that divorce meant only family separation, instability and financial havoc, perhaps they wouldn't divorce so quickly....

Divorce, once done, is irrevocable. Then what? The fathers are to never see their children again? I haven't seen my son since Christmas of 2003. Go preach your sermon to someone else, pastor. And yes, I DO pay my child support, reverend, thank you, your worship!

Where my brother works, there is a divorded man who pays child support, and he does not even have enough money to live, and he lives in his car. Some fathers have really been abused by the system, and do not have the money to keep going back to court. This is a disgrace.

Sounds as if somebody has a little problem with religion. Or at least Christianity. I'm not God, any argument with His Word is an argument with Him, not me. Perhaps it would be helpful to use His Name in vain while you argue with Him. That will likely convince Him that you are smarter than He is. Good luck.

How do you know I didn't "put her away" for "fornication"? I'm a Christian, but the Holier-than-Thou sanctimonious nutjobs do a disservice to our faith.

You like Bible verses, here's one for you:
"Either how canst thou say to thy brother, Brother, let me pull out the mote that is in thine eye, when thou thyself beholdest not the beam that is in thine own eye? Thou hypocrite, cast out first the beam out of thine own eye, and then shalt thou see clearly to pull out the mote that is in thy brother's eye." Luke 6:42

I rarely enjoy it when posters take comments very, very personally and go on the defensive.

I like it when an article or a comment is posted and viewed objectively, when the commentators relate the issue to the overall policies needed in a "free republic".

I accused no one of anything. The Bible verse I posted was intended as a comment about the article. I had no idea that you were divorced or even a man. I am still not sure about the latter. I certainly am not the one jumping to conclusions here, but I am beginning to think that the 'nut job' might be in the eye of the beholder. Have a nice day, and try not to kill anybody.

You tell it brother.

That is a big shame. The bigger shame is that the dads are chopped out of the kids lives.

All of this is being done primarily by which party? Hmmm.

Can we have a free society if the entire population is under the control of judges who have no rules but 'the best interest of the child'?

Fixes:
1) Definitely make divorce harder.
2) Make the person causing the divorce lose the kids.
3) Take the money incentive out of the system.

My husband has been a victim of this system. Pay the money (more than 75% of his income) or else, but no rights to see the kids. I have heard women say O i will get a divorce and i can live with child support money.. This system encourages divorce and separation from kids.
That being said, I am glad this came up on here. Here is how I would like to blow the lid off this, if possible.
Child support is a non- custodial income tax. If it can be recognized as that some brilliant attorney can buy an island or two with a class action suit.
States continue to extort this money, obtain it from someone who is not truly the father and will not adjust the amount no matter how much money you no longer make. They are making an absolute killing off the intrest rate float and federal funds.
No wonder they are coming after your money!
