Convicted Killer in Texas Ready to Die

LIVINGSTON, Texas - Convicted killer James Porter figured he did society a favor by fatally beating a child molester, even though he wound up on death row for the slaying. Now he believes he is doing himself a favor by declining to seek any appeals, ensuring a trip to the Texas death chamber Tuesday.

"I'm the type of individual to face up to my responsibility and my mistakes," Porter said recently in an interview.

At his request, no appeals were pending in the courts and no clemency petition was filed with the Texas Board of Pardons and Paroles.

Porter, 33, was serving a 45-year sentence for the 1995 fatal shooting of a transient when he killed inmate Rudy Delgado in 2000.

Court records show Porter smuggled a rock into his cell, put it in a pillowcase and used it to beat Delgado, who was serving a 15-year term for sexually assaulting a child.

"Dude was a homosexual," Porter said of Delgado. He "asked me several times if that was something I might dig. One day, frustration started eating on me, like a little old black shroud covering my eyes."

"I guess at that time, I just lost all my cool and didn't care anymore."

By the time prison officers stopped the attack, Delgado's "face could not be recognized as being that of a human," said James Elliott, who prosecuted Porter. "And I'm not exaggerating that one bit."

Before his trial, Porter wrote the prosecutor, saying he should be lauded for killing Delgado.

"I said: Hey man, you should give me a certificate of accomplishment for taking this dude out instead of trying to kill me," he recalled. The district attorney used the note against him, telling jurors Porter was boasting and proud of the slaying.

"In a way, I was," Porter said. "That dude never touched any little boys again."

Porter also wrote he would kill again if he did not get the death penalty. "I think he was pretty well determined to get out of the system by murder and that's what he did," Elliott said.

Porter said he now believes he was "wrong to judge" his victim.

"It wasn't my place to re-punish him for something he was already punished for," Porter said. "I'm sorry it happened. That's all I can say."

Defense lawyer Robin Norris said Porter long suffered depression resulting from an abusive childhood that included being raped by one of his stepfathers. He eventually ran away from home and dropped out of school in the eighth grade.

He should have gotten the death penalty for shooting the transient...he should get a medal for killing the pedophile.

IMHO, pedophiles should be given an automatic death sentence if proven guilty!

He's got a point. Maybe we could give him a certificate and the death penalty -- maybe that would be a decent compromise.

If you do an Alta Vista search on Rudy Degaldo there are sites with pictures of him after that beating. His face
is ghastly, "rearranged", looks like it was hit by a truck.

These sites were put up by people who want investigations into Prisoner abuse. They claim the guards could have intervened before Degaldo was beaten to death. Also claim the Prison didn't want Delgalo's family to see his body.
There is no mention at the sites regarding what Degaldo was in prison for but they have a letter posted from another inmate to the Degaldo family who claims he saw the beating.

Be forewarned if you look this up..it is truly a shocking photo.

What ever happened to that lady in California that whacked the scum in the courtroom with a .357 that had molested her kid. He snickered at her and she popped him. Poor lady.:-(

Normally, all the usual left-wing, neocommunist whacko groups would be protesting Porter's execution and demanding it be set aside for dumb reasons, real or imagined. But, since he murdered a tinkerbell, the most terrible crime of all, they agree that he must die!

I did a search and saw several sites on this as well. Notice that NONE of these sites ever talk about what the guy did to be in prison in the first place or what he said to the guy who killed him to set him off. Granted, the guy who killed him was no saint and shouldn't have bashed the guy's skull in... OK, as a parent, maybe THAT wasn't such a bad thing, but some of these sites are ridiculous! There was on e I saw where you could sign a guestbook for the guy's family and people were gushing on and on about how horrific the TDC was. I wonder how they would feel if it had been their child who this guy molested? I wonder if they would have thought his death was so bad then?

Somehow this guy has some redeeming values. A stepfather who had molested him--in jail for many years--Depressed-- and this queer approached him. I think maybe the queer wanted to play with the wrong guy. I cant bring myself to feel sorry for the fruit, Child molesters should have the common sense to STFU when they are in the can.

In the 1980's there was this man in Louisiana. he was waiting in the airport by a payphone when the LA State troopers brought the man who molested his son back from another state. he turned around and emptied a .357 into the guy. He was arrested, and tried for his murder. The jury found him innocent, reason, justifiable homicide. As I understand it they even had to give him his pistol back.

So the guy got ticked off because another man was making passes at him, beat the guy to death by slamming a rock into his skull, and then later came out with a 'oh, well I did you a favor' line. I have no sympathy for anyone involved here, except perhaps for the poor folks who had to clean up the bloody mess after.
