Appeals Court Rejects Terri Schiavo's Parents' Religious Liberties Arguments

Clearwater, FL (LifeNews.com) -- In a decision released Wednesday with no written opinion, Florida's Second District Court of Appeal denied an appeal filed by the parents of disabled woman Terri Schiavo saying that starving her to death would be a violation of her religious liberties.

Bob and Mary Schindler argue that euthanizing Terri would abrogate her First Amendment religious rights. As a Catholic, Terri likely would agree with the church's position against euthanasia.

The Schindlers pointed to recent comments against euthanasia and assisted suicide by Pope John Paul II. The pontiff has said that removing the feeding tube form a disabled patient like Terri constitutes "euthanasia by omission."

The appeals court's decision upholds a ruling by Circuit Court Judge George Greer in October also denying the religious liberties arguments.

Terri's estranged husband Michael praised the appeal courts decision in a press release from George Felos, the euthanasia advocate who is his lead attorney.

Michael called it a "prompt and definitive denial of the Schindlers' frivolous claim."

In an email to LifeNews.com, Terri's father Bob Schindler said he was surprised to lean that Felos had issued the press release before the court notified the Schindlers' attorneys of the decision.

Schindler says the appeals court "did not file an opinion because they could not find any legitimate explanation to reject the appeal motion."

When the appeals court's decision is finalized in fifteen days, the stay put in place by Judge Greer will be lifted. At that point, Michael will again be able to tell doctors to remove the feeding tube.

If removed, medical experts say Terri will die from a seven to ten day painful and agonizing death as she is denied food and water.

The Schindlers can ask the appeals court to rehear the motion or can appeal the decision to the Florida Supreme Court, which has previously ruled against them.

In either case, a new request of Judge Greer must be made to issue another stay preventing Michael from taking Terri's life.

Hi, tut -- you've got that right. *sigh*

Thanks for all the work you've done, pc. It is discouraging that we do not see results and that those who have the power to act do not. In my emails to Gov. Bush, I always add a line encouraging him to remove Terri from Michael's custody. Let us continue to do the little things we see to do, regardless of anything else or anyone else.

Thanks for everything you do. I had an idea that if anyone and their children or just a group of children for Terri could call Crimestoppers and get McGruff to act. Someone had called Crimestoppers and got a case number and I had the idea that what if a bunch of kids for Terri did the same? I guess they would need a script of poignant laws being broken, etc.

You knew that they would reject the appeal.

They are covering for the other crooks.

If Teri is allowed to live too many people in high places are going to be in trouble, therefore Teri must die.

I wish some honest investigative reporter or crime writer (such as Ann Rule or Mark Fuhrman) would write a book about this horror story.

It has the elements of a best seller: the estranged husband, a sadistic cad who goes to extreme lengths to torment and try to kill his wife and hurt his in-laws; a sleazy mistress; corrupt judges who have set themselves up as little dictators and have sentenced her to die a horrible death that is not even allowed for the worst of criminals; the creepy Felos who is like something out of a nightmare; the strange death of the mistress's mother who plotted against the wife as well as the "assisted" death's of the estranged husband's parents. And many of you here who have done so much to try to save Terri.

There's a Florida Baptist News article within another Terri thread. Hospice would not allow Christmas Carolers anywhere NEAR TERRI. I think they are afraid she'll remember something if she hears Christmas music.

The Carolers wanted to entertain Terri but they treat her like a sub-human. I am so ashamed of Florida and of Pinellas County.

THIS IS so evil and Terri never said to starve and dehydrate her. She said "Where there is life there is hope."

If anyone on this thread wants to join TERRI'S FREEPERS, let me know and I'll put you on my list. Happy New Year,

If Jeb doesn't protect Terri if the SCOTUS doesn't take Terri's Law, the Republicans won't win Florida ever again. The portion of the Florida GOP who knows a murder when they smell one after a robbery I might add, THEY WILL LEAVE THE PARTY in numbers high enough to put the state back in the blue column.

If the GOP wants to permanently tick us off, they can sit on their hands and watch Terri be murdered by republican judges. It's despicable.

Who needs hit men when you can shop a judge who will make all the arrangements and even hand you a fortune???

I am beyond p-oed. All I can say is that we are not going to go away, no matter what the final outcome is. The corruption starts at the top.

Where's the fbi when you need them? As world net daily has pointed out, this is one of the biggest coverups out there.

There's so much corruption here that is already being exposed - they cannot get all of us but I don't want Terri to be a human sacrifice for the hemlock society members who want to litigate people to death. It's their mission statement. Judge shop for puppets LIKE GREER AND BAIRD and then shop for victims. That's what happened to Terri. She was safe until someone found out about her. The attorneys found out about her, planted themselves at Hospice and convinced Michael that he could get rid of Terri and then they took her rehab funds for fees (WHICH WAS ILLEGAL). Thank you, Judge Greer, just one of Hitler's apprentices.
