WASHINGTON--(BUSINESS WIRE)--Dec. 29, 2004--The American Center for Law and Justice, which represents the parents of Terri Schiavo in a legal battle to keep their daughter alive, today asked the U.S. Supreme Court to take the Florida case in which the Florida Supreme Court declared unconstitutional "Terri's Law" - a state law enabling Florida Governor Jeb Bush to save Terri from starvation and dehydration. The ACLJ today filed an amicus brief with the high court on behalf of Mary and Robert Schindler - Terri's parents - in support of a petition filed by Governor Bush asking the high court to take the case.

"This is a case that certainly deserves consideration by the Supreme Court and we are supporting the Governor's office in its effort to have the high court take this critically important case," said Jay Sekulow, Chief Counsel of the ACLJ, which is representing the Schindlers in their efforts to defend the emergency Florida legislation that saved their daughter's life. "At the center of this life and death struggle is Terri Schiavo - a woman who has received a death sentence from the Florida courts. The Governor and legislature acted properly and constitutionally in passing 'Terri's Law.' We are asking the high court to take this case to protect the life of Terri Schiavo by upholding the constitutionality of Florida's decision to enact life-saving legislation - the measure that saved Terri's life."

said the decision by the Florida Supreme Court is an "astonishing and unprecedented ruling" and encouraged the high court to send the case back to the Florida Supreme Court for further clarification prior to accepting the case.

The brief argues that the Florida Supreme Court acted unconstitutionally in its decision when it determined that once any court has issued a decree regarding the care and treatment of an incompetent person, neither the legislature nor the executive branch can take independent steps on behalf of the incompetent person's welfare. The brief states that "the state supreme court's construction of the Florida Constitution to produce such a ruling renders that state constitution, as applied, unconstitutional under the federal constitution ..."

The brief also asserts that Terri Schiavo, a disabled woman whose husband wants her life to end, is not in a persistent vegetative state, as alleged by her husband, that her condition is not terminal and untreatable, and that she is aware of her surroundings and does not want to die - especially by starvation and dehydration.

Governor Bush acting under "Terri's Law," ordered feeding and hydration tubes to be restored to Terri after a Florida trial court had ordered them removed. On behalf of the Schindlers, the ACLJ urged the state's highest court in Bush v. Schiavo to reverse a lower court ruling that struck down "Terri's Law" as unconstitutional. In September 2004, the Florida Supreme Court upheld the lower court decision.

Check this out from Judge Greer's personal Courtroom Guidelines. Too bad he doesn't follow his own guardianship guidelines.

III. Guardianship

1. On the Petition for Appointment of Emergency Temporary Guardian, Judge Greer feels that it should be brought to the Court only in a circumstance of life, death or substantial waste of property.

After much effort to gain visitation privileges stalled for months by the spiteful estranged, adulterous husband Michael Schiavo, attorneys for the parents of Terri Schiavo have finally been permitted to visit the disabled woman whom they have expended much time and cost to secure her freedom, and right to be heard through proper rehabilitation she by retains right to receive.

Attorney Barbara Weller, spokeswoman and coattorney on this case for the David Gibbs Law Firm in Seminole, Florida is a woman who has endured the endless research of the 42 volumes of Terri's guardianship file, thousands of pages of court transcripts from hundreds of court hearings and trials, the representations by the media of Terri being in a Coma state, Terri's husband's agreements with his hired doctors and news statements that Terri is unconscious and unable to relate with her environment and now for the very first time, was permitted to visit her client's disabled daughter, and is now expressing her outrage toward the court system.

Commenting on Terri Schiavo’s physical condition, Weller said the 41-year-old woman had a “peaches and cream complexion and gorgeous white teeth,” rather than being “gray and sallow” from not being allowed regular forages to the outside.

“Terri is a beautiful woman who radiates light,” Weller said.

Weller said she is surprised that the court of appeal has appeared to treat the case in such a “cavalier manner,” and has not considered all of the implications.

“The religious issue is very important in Florida,” Weller said. “It was extremely insulting how this was handled.” Although options for an appeal to the recent motion filed with Judge Greer appear to be exhausted, Weller said her firm is planning to file about 4-5 other legal motions related to the case in the next few weeks.<<<

Weller joins a growing list of people who really do know the true condition of Terri Schiavo and now has a perspective that is sure to show up in the Gibbs Law Firm's actions to stop this premeditated judicial attempted homicide.

Documents certified by the Clerk of the Court exist that [prove] conspiracy on the part of Attorneys Deborah Bushnell and George Felos -- which they both attempted to have sealed by the court -- which prove their discussions and planning to intentionally starve Terri Schiavo. Meeting(s) prior to Michael Schiavo ever being asked to meet George Felos or the surfacing 2.5 years after that 12/13/95 murder plot discussion of Michael's "remembering" Terri's alleged "wishes to not live this way". 'Wishes' he conveniently forgot when crying and begging a malpractice jury for millions of dollars to care for and rehabilitate his real wife, Terri, as he vowed to do when he married her in 1986 and again to that Jury and Judge.

To date this murder plot meets refusal in being heard by a complicit law enforcement system, the criminal courts, state attorney, FBI, FDLE, Inspector General and government agencies who are aiding Attorney Felos and Judge Greer in this agenda of precedent setting Judicial homicide of a disabled woman being Criminally denied the protections and retained rights Florida laws are supposed to be providing her.

Meanwhile, others who commit the same crimes around the state and country are being prosecuted for the same or similar activities.

There are people in worse shape than Terri who go to amusement parks and RIDE THE RIDES, i.e. roller coasters. The truth must be shouted from the rooftops. TERRI IS ALERT AND AWARE OF HER SURROUNDINGS. THERE WAS NO LIVING WILL. IT IS THE HUSBANDS' LAWYERS WISHES THAT SHE BE STARVED AND DEHYDRATED TO DEATH.
