Sober drivers commit 53% of all driving deaths, the .08 drivers just 1.8% of the deaths. The law is designed for profit, not safety. The drunks who kill are .15%. Make the .15 level mandatory jail time and make .08 the same fine as going 20 mph over the speed limit, as it is no more dangerous.

The very real danger I encounter several times a day is the sober cell-phoned soccer mom in a Suburban doing her make up while swerving two lanes at a time. They should be fined to the gills for this activity, as they cause countless accidents. I'll take a .08 driver any day over this nonsense.

T. Jefferson has it right. The .08 drivers aren't causing the accidents. There are no studies now nor before the limit was dropped to show dropping the limit would reduce accidents. I know because as a reporter I asked the N.J. State Police to supply documentation supporting their recommendation to lower the limit. The spokesman just laughed and admitted there was no research, no evidence. I believe it occurred because of federal blackmanil, though. States had to comply or lose federal highway funding.
Remember, another study showed that 67 percent of all drivers in accidents didn't have the benefit of marijuana in their system. (That would be the reverse of the actual published study that said 32 percent of drivers in serious accidents had traces of marijuana in their system. Of course, you test positive for marijuana for a month or more after last use.

Yesterday, a 30-something gal passed me on the highway (in an SUV) holding a cell phone to her ear with her right hand and holding and reading something while steering with her left hand!

I gave her a wide berth and watched her continue to zip along in the fast lane, position unchanged, until I exited the road about 3 miles later.
