Any candidate who isn't a RAT must win outside the 'margin of litigation'. It didn't happen in this case....just too bad.
Thankfully Bush got outside of the 'margin of litigation' in OH. If SKerry would have gotten about 100k more votes we may still not have a decision, and in a worse case scenario be on the brink of crisis.

True, but Bush still would have been in a much, MUCH better position than Rossi was. Kerry doesn't have all his "friends" in charge of OH the way Gregoire does in WA. We wouldn't have to worry about 2-1 democrat county election boards inevitably overruling the lone republican since OH is 2R-2D.
Unfortunately, with almost the entire political power structure in WA being controlled by the dems, with a margin this close, it was pretty much curtains for Rossi from the very beginning.
