That just makes me sick. WHO CARES what a brutal murderer's IQ is? Finding out that the perpetrator is retarded does nothing to undo the murder. If they're too stupid to stop themselves from hacking people up, they need to be taken out of society like every other crackpot. Federal law prohibits anyone who is legally retarded from getting the DP. The idea is that they can't understand that they are being put to death so it is therefore cruel and unusual punishment. Most prosecutors wouldn't try to get the death penalty for someone who is truly retarded, and while I've personally seen it argued as a defense in probably half a dozen or more cases, each one of them was a "borderline" case where the IQ was actually a few points higher than the standard for mental retardation.
