No, once their rescue efforts had failed, the soldiers should have just let the severely injured boy burn to death in the truck he was trapped in. That would be the "right" (legal) thing to do. Crummy way to treat a compassionate soldier.
After the Fallujah incident and this, it would be well for any soldier or Marine to forthwith dispense with any compassion they might feel toward the enemy. Too much liability. No wounded prisoners. If you decide to take them under fire, keep firing until you are absolutely certain they are all dead. Otherwise, you are going to have to worry about all the bleeding hearts and their lawyers.
